1. Who we are

These terms govern your use of services provided by Landzaya ("Landzaya", "we", "us"), a land intelligence service operating in Kenya. By using the site or purchasing a report, you agree to these terms.

2. The service

Landzaya provides automated land intelligence reports combining flood, soil, infrastructure, crop suitability, and build-cost data drawn from public and licensed sources. Reports are produced on demand from the coordinates you supply and are intended to inform — not replace — independent professional advice (surveyor, advocate, valuer).

3. Acceptable use

You agree not to: (a) use the service unlawfully, (b) attempt to bypass paywalls or rate limits, (c) scrape, reverse-engineer, or resell our reports, (d) upload malicious content, or (e) infringe any third-party rights. We may suspend accounts that breach these rules.

4. Accounts

You're responsible for keeping your login credentials confidential and for activity under your account. Provide accurate information and keep it current.

5. Payments, billing, refunds

Payments for Landzaya reports are processed directly via Safaricom M-PESA (Lipa Na M-PESA Online). Charges appear on your M-PESA statement and are billed in Kenyan Shillings. Our Refund Policy describes when refunds apply.

6. Intellectual property

Landzaya retains ownership of the platform, software, branding, and the structured presentation of report data. You may use reports for your own land-buying decisions and share them with your professional advisors, but you may not republish or commercially redistribute them.

7. Accuracy & disclaimers

Reports are generated from third-party data sources (ISRIC SoilGrids, Open-Meteo, OpenStreetMap, government open data, and our own models). We work hard to be accurate but we do not guarantee uninterrupted, error-free, or perfectly current data. Reports are informational — not a substitute for an on-site survey, legal title search, or licensed valuation. To the fullest extent permitted by law, we disclaim all implied warranties.

8. Liability

To the extent permitted by Kenyan law, Landzaya's aggregate liability for any claim is capped at the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages (loss of profit, loss of opportunity, loss of data). Nothing here excludes liability that cannot lawfully be excluded.

9. Suspension & termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your access ends; reports already generated remain accessible while your account exists.

10. Governing law

These terms are governed by the laws of Kenya. Disputes will be resolved in the courts of Nairobi.
